　　八、甲方的責(zé)任：

　　8.1 甲方須按時將出租房屋及其家私家具用品與其設(shè)施以良好狀態(tài)交付乙方使用。

　　8.2 租賃期內(nèi)甲方不得收回出租房屋(除非本合同另有規(guī)定)，甲方保證乙方可不受干擾的享用該物業(yè)。

　　8.3 在乙方遵守本合同的條款及支付租金的前提下，乙方有權(quán)于租賃期內(nèi)拒絕甲方或其他人騷擾而安靜享用出租房屋。

　　8.4 租賃期內(nèi)出租房屋的結(jié)構(gòu)，進(jìn)出物業(yè)的排水、上下管道、電路等處于良好使用狀態(tài)。

　　九、乙方的責(zé)任：

　　9.1 乙方應(yīng)按合同的規(guī)定，按時支付租金，保證金及其他各項應(yīng)付費(fèi)用。

　　9.2 乙方應(yīng)愛護(hù)使用出租房屋，如因乙方的過失或過錯致使房屋設(shè)施及屋內(nèi)用具和飾品受到損壞(正常損耗除外)，乙方應(yīng)負(fù)賠償責(zé)任。

　　9.3 乙方應(yīng)按本合同的約定合法使用出租房屋，不得擅自改變使用性質(zhì)，不應(yīng)存放中華人民共和國法律下所禁止的危險物品，如因此發(fā)生損害，乙方應(yīng)承擔(dān)全部責(zé)任。

　　十、違約處理：

　　10.1 甲、乙任何一方如未按本合同的條款履行，構(gòu)成違約，應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。雙方同意違約方應(yīng)賠償守約方之直接損失人民幣____________元。

　　alters the structure of the leased property or uses the leased property other than for the purpose started herein without party a’s consent;

　　c.無故拖欠租金超過三天(除雙方就本合同存在爭議除外)。

　　fails to pay rent without any reason for more than thirty (30)days after the due date except where there is a dispute in respect of this agreement.

　　十一、適用法律：

　　本合同的成立，其有效性、結(jié)實、簽署和解決與其他有關(guān)的一切糾紛均應(yīng)受中國法律的管轄并依據(jù)中國法律解釋。

　　Mrs. Ghazala Waheed w/o Abdul Waheed, Adult, R/o House No.-*, DHA, Lahore Cantt, (hereinafter to as the LESSOR of the ONE PART).

　　And

　　Mr.* ,R/o China, refereed to as the LESSEE of the OTHER PART.(Expression “LESSOR”

　　and “LESSEE” wherever the context so permit shall always mean and include their respective heirs, successors legal representative and assignees).

　　WHEREAS the LESSOR is the lawful owner and in lawful possession of House No,-*,DHA,

　　Lahore Cantt, consisting of 4 Bedrooms with bath, D/D,TV; Lounge, Kitchen, Store, Servant, Quarter together with fixtures and fitting (hereinafter collectively called the DEMISED PREMISES).

　　AND WHEREAS the LESSOR has agreed the lease and the LESSEE has agreed to take on lease the DEMISED PREMISES on the terms and condition as given below:-

　　第八條 房屋的轉(zhuǎn)讓與轉(zhuǎn)租

　　1、租賃期間，甲方有權(quán)依照法定程序轉(zhuǎn)讓該出租的房屋，轉(zhuǎn)讓后，本合同對新的房屋所有人和乙方繼續(xù)有效。

　　2、 未經(jīng)甲方同意，乙方不得轉(zhuǎn)租、轉(zhuǎn)借承租房屋。

　　3、甲方出售房屋，須在 個月前書面通知乙方，在同等條件下，乙方有優(yōu)先購買權(quán)。

　　第九條 合同的變更、解除與終止

　　1、雙方可以協(xié)商變更或終止本合同。

　　2、甲方有以下行為之一的，乙方有權(quán)解除合同：

　　(1)不能提供房屋或所提供房屋不符合約定條件，嚴(yán)重影響居住。

　　(2)甲方未盡房屋修繕義務(wù)，嚴(yán)重影響居住的。

　　3、房屋租賃期間，乙方有下列行為之一的，甲方有權(quán)解除合同，收回出租房屋;

　　(1)未經(jīng)甲方書面同意，轉(zhuǎn)租、轉(zhuǎn)借承租房屋。

　　(2)未經(jīng)甲方書面同意，拆改變動房屋結(jié)構(gòu)。

　　(3)損壞承租房屋，在甲方提出的合理期限內(nèi)仍未修復(fù)的。

　　(4)未經(jīng)甲方書面同意，改變本合同約定的房屋租賃用途。

　　(5)利用承租房屋存放危險物品或進(jìn)行違法活動。

　　(6)逾期未交納按約定應(yīng)當(dāng)由乙方交納的各項費(fèi)用，已經(jīng)給甲方造成嚴(yán)重?fù)p害的。

　　(7)拖欠房租累計 個月以上。

　　4、租賃期滿前，乙方要繼續(xù)租賃的，應(yīng)當(dāng)在租賃期滿 個月前書面通知甲方。如甲方在租期屆滿后仍要對外出租的，在同等條件下，乙方享有優(yōu)先承租權(quán)。

　　5、租賃期滿合同自然終止。

　　6、因不可抗力因素導(dǎo)致合同無法履行的，合同終止。

　　第十條 房屋交付及收回的驗收

　　1、甲方應(yīng)保證租賃房屋本身及附屬設(shè)施、設(shè)備處于能夠正常使用狀態(tài)。

　　2、驗收時雙方共同參與，如對裝修、器物等硬件設(shè)施、設(shè)備有異議應(yīng)當(dāng)場提出。當(dāng)場難以檢測判斷的，應(yīng)于 日內(nèi)向?qū)Ψ街鲝垺?/p>

　　3、乙方應(yīng)于房屋租賃期滿后，將承租房屋及附屬設(shè)施、設(shè)備交還甲方。

　　4、乙方交還甲方房屋應(yīng)當(dāng)保持房屋及設(shè)施、設(shè)備的完好狀態(tài)，不得留存物品或影響房屋的正常使用。對未經(jīng)同意留存的物品，甲方有權(quán)處置。

　　第十一條 甲方違約責(zé)任處理規(guī)定

　　1、甲方因不能提供本合同約定的房屋而解除合同的，應(yīng)支付乙方本合同租金總額 %的違約金。甲方除應(yīng)按約定支付違約金外，還應(yīng)對超出違約金以外的損失進(jìn)行賠償。

　　2、如乙方要求甲方繼續(xù)履行合同的，甲方每逾期交房一日，則每日應(yīng)向乙方支付日租金 倍的滯納金。甲方還應(yīng)承擔(dān)因逾期交付給乙方造成的損失。

　　3、由于甲方怠于履行維修義務(wù)或情況緊急，乙方組織維修的，甲方應(yīng)支付乙方費(fèi)用或折抵租金，但乙方應(yīng)提供有效憑證。

　　4、甲方違反本合同約定，提前收回房屋的，應(yīng)按照合同總租金的 %向乙方支付違約金，若支付的違約金不足彌補(bǔ)乙方損失的，甲方還應(yīng)該承擔(dān)賠償責(zé)任。

　　5、甲方因房屋權(quán)屬瑕疵或非法出租房屋而導(dǎo)致本合同無效時，甲方應(yīng)賠償乙方損失。

　　第十二條 乙方違約責(zé)任

　　1、租賃期間，乙方有下列行為之一的，甲方有權(quán)終止合同，收回該房屋，乙方應(yīng)按照合同總租金的 %向甲方支付違約金。若支付的違約金不足彌補(bǔ)甲方損失的，乙方還應(yīng)負(fù)責(zé)賠償直至達(dá)到彌補(bǔ)全部損失為止。

　　(1)未經(jīng)甲方書面同意，將房屋轉(zhuǎn)租、轉(zhuǎn)借給他人使用的;

　　(2)未經(jīng)甲方書面同意，拆改變動房屋結(jié)構(gòu)或損壞房屋;

　　(3)改變本合同規(guī)定的租賃用途或利用該房屋進(jìn)行違法活動的;

　　(4)拖欠房租累計 個月以上的。

　　2、在租賃期內(nèi)，乙方逾期交納本合同約定應(yīng)由乙方負(fù)擔(dān)的費(fèi)用的，每逾期一天，則應(yīng)按上述費(fèi)用總額的 %支付甲方滯納金。

　　3、在租賃期內(nèi)，乙方未經(jīng)甲方同意，中途擅自退租的，乙方應(yīng)該按合同總租金 %的額度向甲方支付違約金。若支付的違約金不足彌補(bǔ)甲方損失的，乙方還應(yīng)承擔(dān)賠償責(zé)任。

　　4、乙方如逾期支付租金,每逾期一日,則乙方須按日租金的 倍支付滯納金。

　　第十三條 免責(zé)條件

　　1、因不可抗力原因致使本合同不能繼續(xù)履行或造成的損失，甲、乙雙方互不承擔(dān)責(zé)任。

　　2、因國家政策需要拆除或改造已租賃的房屋，使甲、乙雙方造成損失的，互不承擔(dān)責(zé)任。

　　3、因上述原因而終止合同的，租金按照實際使用時間計算，不足整月的按天數(shù)計算，多退少補(bǔ)。

　　4、不可抗力系指"不能預(yù)見、不能避免并不能克服的客觀情況"。

　　第十四條 本合同未盡事宜，經(jīng)甲、乙雙方協(xié)商一致，可訂立補(bǔ)充條款。補(bǔ)充條款及附件均為本合同組成部分，與本合同具有同等法律效力。
